H.J.Res. 78, the "Religious Freedom Amendment," would amend the Constitution in a manner that would overturn many judicial interpretations of the religion clauses of the First Amendment that have been based on a separationist perspective. This report details the legislative, political, and constitutional context of the proposal and analyzes its legal effect if ratified as part of the Constitution.
